Before filing for divorce in Texas, at least one spouse must meet the following residency criteria:
- Resided in Texas for at least six months, and
- Lived in the county where the divorce is filed for at least 90 days
Texas law permits both no-fault and fault-based divorces, offering flexibility depending on the circumstances of the marriage.The most commonly cited ground for divorce in Texas is insupportability. This means that due to conflict or discord of personalities, the marriage has become unsustainable, and there is no reasonable expectation of reconciliation. No specific wrongdoing is required to file under this ground. If you wish to seek a fault-based divorce then Texas recognizes several fault-based grounds for divorce, which may influence outcomes related to property division or custody. These include:
- Adultery
- Cruelty (emotional or physical treatment making the marriage intolerable)
- Abandonment (for a minimum of one year)
- Felony conviction (with at least one year of incarceration)
- Living apart (continuously for at least three years)
- Confinement in a mental health facility (for at least three years, with a poor prognosis for recovery)
